What is the Moral Right ?
Like the Composers and Writers, the Performer has a moral right to perform it (recording a song, film, television, etc.).
What is that moral right?
1. The Performers has a right whose name will be mentioned in every Performance. That is, everything recorded, whether in a song or in a film, or in any other performance, in audio or in audio-visual. In any original performance or in its reproductions – its name must be specified in the standard scope.
2. The second major issue in the moral right is to preserve the “Integrity of its Performance” in its original performance or in its reproductions. In other words, it should not be distorted or altered, which may reduce its original value or may harm the honour or reputation of the performer.
3. In case the Perfomer’s moral right has been violated, the performer may claim compensation for the harm and, in some cases, an injunction. In a judgment in the Magistrate’s Court, for example, the Honorable Judge ruled a sum of NIS 50,000 to be awarded to the Singer Ronit Roland due to the fact that Galatz Radio station announcers did not read her name when she performed a song with the “Mayumana” band. This is a violation of her rights and her feelings as well as her professional respect.
Generally (and as stated in the Beijing International Convention) it is customary to view the moral right as personal, and it does not transferable even if other economic rights are voluntarily sold to others.
